أصدرت المحكمة الدستورية في النمسا الجمعة قرارا يبطل قانونا أُقر العام الماضي وينص على حظر ارتداء الفتيات لغطاء الرأس في المدارس الابتدائية. واعتبرت المحكمة أن القانون غير دستوري وتمييزي مشيرة إلى أنه “يتعارض مع مبدأ المساواة في ما يتعلق بحرية الدين والمعتقد”.

أبطلت المحكمة الدستورية في النمسا الجمعة قانونا أُقر العام الماضي وينص على حظر ارتداء الفتيات لغطاء الرأس في المدارس الابتدائية، معتبرة أنه غير دستوري وتمييزي.

واعتبرت المحكمة في بيان لشرح قرارها أن القانون “يتعارض مع مبدأ المساواة في ما يتعلق بحرية الدين والمعتقد”.

وطعنت طفلتان ووالديهما بالقانون الذي يمنع الفتيات اللواتي تبلغ أعمارهن أقل من 10 سنوات ارتداء الحجاب في المدرسة.

وكان القانون قد أقر في أيار/مايو عام 2019 في ظل التحالف الحكومي السابق بين حزب الشعب من يمين الوسط وحزب الحرية اليميني المتطرف، قبل انهيار هذه الحكومة بسبب فضيحة فساد.
