الجيريان اكسبرس: قررت المحكمة الإدارية في مدينة مانهايم غربي ألمانيا إلغاء تطبيق حظر التجول المفروض من الساعة الثامنة مساء حتى الخامسة صباحا، الذي فرضته ولاية بادن فورتمبيرغ بسبب جائحة كورونا.

وقالت المحكمة إن القاعدة التي فرضتها الولاية لم تستوف الشروط القانونية، مشيرة إلى أن قانون الحماية من العدوى يتيح فرض قيود على التجول فقط إذا أدى إهمالها إلى أضرار على مكافحة الوباء.

وأضافت المحكمة أن من الممكن التفكير في هذه القيود فقط إذا أدى التخلي عن قيود حظر التجول إلى تفاقم كبير في معدل الإصابات مع أخذ جميع التدابير الأخرى المتخذة في الاعتبار.

ورأت المحكمة أن على حكومة الولاية أن تدرس ما إذا كان يتعين فرض هذه القيود على التجول على مستوى ألمانيا أو ما إذا كان من الممكن فرض قواعد أكثر تمايزا على أساس تطورات العدوى على الصعيد المحلي.

ونوهت المحكمة إلى أن الولاية لم تف في هذه المرة بالمتطلبات القانونية على عكس ما كان عليه الحال في نهاية ديسمبر ومنتصف يناير الماضيين عندما فشلت دعوات مستعجلة ضد قراراتها.
